How Long do I have to File a Mechanic's Lien (Also Known as a Construction Lien) in New York?

Commercial properties have 8 (eight) months, and residential properties have only 4 (four) months from the date of completion to file a lien. CAUTION: There is one exception! If the notice of lien is for retainage, you have 90 (ninety) days from the day the retainage was to be released.

What is Needed to File a Mechanic’s Lien?

To file a Mechanic’s Lien, you need the name and address of the lienor (you, your business or your corporation), the name and address of your attorney if applicable, the name of the lienee (your client or their business or corporation), the details of who you are in relation to the contract (subcontractor, supplier, etc.), the details and price of the project, the amount unpaid, the times of the first and last work and the property subject to lien.

Can You File a Lien After 90 Days in New York?

Absolutely! You have 8 (eight) months after the project to file a lien for a commercial job and 4 (four) months for a residential job. The only exception is if your claim is for retainage (a portion of your payment retained by the client until work is completed to their satisfaction), in which case you do only have 90 (ninety) days and cannot file after that.
