What is an Arizona Preliminary Twenty Day Lien Notice?

If you are improving a construction project you are required to send a 20-day preliminary notice from first furnishing labor and/or material to a project. If you do not send the preliminary 20- day notice you will lose your lien and/or bond claim rights.

How do I file a Notice and Claim of Lien in Arizona?

Once your preliminary notice has been sent if you do not get paid, you can start the lien process. You have 120 days from last furnishing labor and/or material to file a lien on the project for nonpayment. WARNING If a notice of completion has been filed, your time is reduced to 60 days from last furnishing labor and/or material to file a lien. The lien must be recorded in the county where you are making the improvements.

How long does a contractor have to file a lien in Arizona?

120 Days from the end of the project or 60 days if a Notice of Completion is filed.

What makes a project “complete” by law?

1. The project is considered completed 30 days after a Certification of Completion OR 2. 30 days after the last work (either labor or furnished tools) on the property OR 3. After any period of 60 consecutive days of cessation of work (i.e. If you stop working on the project on January 1st and the project is not done but you still are not working on March 1st the project is considered complete for lien purposes. )

Can an unlicensed contractor file a lien in Arizona?

No, under Arizona law unlicensed contractors cannot secure lien rights.

How long does a lien last in Arizona?

Your lien will expire in 6 months if foreclosure action is not taken.

What if I send the Arizona Preliminary Notice Late?

Don’t worry! If you send the notice late you can still secure a Lien, however, the preliminary notice will only go back 20 days. For example, if your work started April 1st and you filed your notice on April 25th the work from the 1st to the 5th is not protected by the lien.
